张万库 律师

　　张万库，1994年毕业于吉林大学法学院，吉林石力律师事务所设立合伙人，高级律师。曾被吉林省松原市司法局和律师协会授予其“松原市十佳律师”“优秀律师”称号，现任松原市仲裁委员会仲裁员。

松原市首例国际仲裁案：
　　2003年6月2日，申请人Northeast Chemicals Purchasing Inc.（美国东北化工国际采购公司）以松原市柠檬酸厂为被申请人向中国国际经济贸易仲裁委员会提出仲裁申请，请求被申请人赔偿预期利润损失153,813美元和承担律师费用、仲裁费用。市政府立即组织外贸专家、法律专家研究应诉方案，最后决定由张万库律师代理。张律师经过对美方提出的没有履行的这两份合同订立、履行、变更和终止过程的分析，发现美方伪造了一份合同，而另一份则是在利用空白抬头提单做文章。对于美方没有收到货物的主张，张律师直接出示了在公证机关监督下调取的美方给中方厂长发出的“收到提货提单”，“请求缓付货款”等8份电子邮件公证书，美方虽以多次改动电子邮箱予以反驳，但已回天无力。2004年6月5日，中国国际经济贸易仲裁委员会裁决驳回了美方的全部仲裁请求。

Mr. Zhang Wanku

The first international arbitration case of Songyuan:
In June 2 of 2003, the Applicant, Northeast Chemicals Purchasing Inc., applied to China International Economic and Trade Arbitration Commission for an arbitration, requested Songyuan Citric Acid Factory, the party against whom an application is filed, to compensate for the expected return lose, which is valued at US$153,813, and respond for the retaining fee and arbitration fee. The municipal government immediately organized the foreign trade experts and legal experts to work on the defend, and decided to choose Zhang as the attorney agent. After an analysis on the process of the concluding, implementation, changing and termination of the two contracts, which was named as no-implemental contract by the Applicant, Zhang found that one of the two contracts was forged by the Applicant, and another one took advantage of a bill of lading with blank title. For the Applicant’s claim that they didn’t received any goods, Zhang showed eight certificated emails on subjects such as “Receive of the bill of lading”, and  “Application for delay of paying for the goods”, which was sent by the Applicant to the factory. Although the Applicant tried to changed his email box to retort, but failed. In June 5 of 2004, China International Economic and Trade Arbitration Commission arbitrated that refute all of arbitration application of the Applicant.
